There is no doubt in my mind that it is your fault in terms of payment. The driver in the POS will probably claim some hospital/bodily injury and car repairs. The best suggestion is to let the insurance company handle all the settlements and then take it in the ass when they jack up your rates. Sorry, but your case is pretty open and shut. Make sure you fax all documents to your agent so he/she can tell you what info you need to provide. Your insurance company should take care of everything - that's why you pay the premium.
